Security Deposits in Ohio: What Renters Should Know Before Move-In

A security deposit is often the biggest upfront cost of a new apartment after the first month's rent, and the one renters worry about most when they move out. Knowing the basics of how Ohio handles deposits can help you protect your money from day one.

What Ohio Law Says

Under Ohio Revised Code Section 5321.16, as summarized by Ohio Legal Help, here are the key points:

•       Return deadline: your landlord must return your deposit, or give you an explanation of anything kept, within 30 days after you move out

•       Forwarding address: you need to give your landlord your new address in writing so the deposit can be sent to you

•       Interest: if the deposit is more than one month's rent and you stay six months or longer, the landlord owes 5% annual interest on the amount above one month's rent

•       No fixed cap: the state doesn't set a maximum deposit amount, and your lease spells out what it covers

What Can and Can't Be Deducted

A landlord may generally deduct for unpaid rent and for damage that goes beyond normal wear and tear. Ordinary wear, like minor scuffs on walls or worn carpet from regular use, shouldn't come out of your deposit. If money is kept, you're entitled to a specific, itemized list of reasons, since a vague line like cleaning fees isn't enough. If you believe your deposit was wrongly withheld, tenants can pursue a claim, including in small claims court.

How to Protect Your Deposit

•       Photograph and video every room on move-in day, including existing marks or damage

•       Complete the move-in condition report carefully and keep a copy

•       Report maintenance problems in writing so there is a record

•       Clean thoroughly and take dated photos when you move out

•       Send your forwarding address in writing and keep proof that you sent it

Questions to Ask Before You Sign

•       How much is the deposit, and what does it cover?

•       Are there application, administrative, or pet fees on top of it?

•       When and how is the move-in inspection done?

•       How should I submit my forwarding address when I move out?

This post is general information, not legal advice. Laws change, so check current Ohio law or contact a legal aid office if you have a specific dispute.
